The issues in a family law case legally are in the following order of importance;

1) Child Custody & Access

Who will have Custody?

Who will have Access?

When and where will access take place - It must be specified

2) Support

Children-  based on the gross income of the non custodial parent - amount as set out in the Provincial Child and Federal Support  Guidelines.

Spousal support depending on the parties income

3) Division of Family Property

Applies only to married couples with some exceptions for common law couples.

There must be an equal division of what is called Net Family Property between the spouses. Net Family Property is the Equity in property after deducting all debt (mortgages)
